Terms of Service

YourMD PLLC | www.yourmdcare.com

Effective Date: January 1st, 2026 | Last Updated: October 1st, 2026

1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of www.yourmdcare.com (the "Website") and any online services, scheduling tools, patient portals, or telehealth features offered by yourMD PLLC ("yourMD," "we," "us," or "our") (together, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old, or the parent or legal guardian of a minor patient, to use the Services.

2. Not Medical Advice; No Emergency Services

The Website is for general informational and administrative purposes only. Content on the Website, including text, graphics, articles, and other materials, is not medical advice and does not diagnose, treat, or prevent any condition. It is not a substitute for professional medical judgment.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Website, email, text messages, or online forms to seek emergency care. If you are in crisis or considering self-harm, call or text 988 (Suicide & Crisis Lifeline).

3. No Provider-Patient Relationship Through the Website

Visiting the Website, submitting a form, or sending us a message does not create a provider-patient relationship. A relationship is formed only when a yourMD provider agrees to provide care and you have completed the required intake, consent, and registration steps, whether in person or through telehealth.

Information you send through the Website before a relationship is established may not be treated as confidential in the same way as information shared with your provider during care. Please do not send sensitive health information through general contact forms.

4. Telehealth Services

If we offer telehealth visits, the following applies in addition to any telehealth consent you sign:

  • Telehealth is available only to patients physically located in Nevada, or in another state where our providers are licensed and authorized to practice, at the time of the visit.

  • You are responsible for having a device, internet connection, and private location suitable for a visit.

  • Telehealth has limitations, including technology failures and the inability to perform a physical exam. Your provider may decide that an in-person visit or emergency care is more appropriate.

  • You agree not to record a visit unless all participants consent in advance.

5. Accounts and Portal Access

If you create an account or use a patient portal, you agree to provide accurate and current information, keep your login credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity under your account. We may suspend or terminate access if we believe an account is being misused or to protect the security of the Services.

6. Appointments, Fees, and Payment

  • Scheduling. Appointment requests made online are not confirmed until we confirm them.

  • Fees. You are responsible for fees for services you receive, including any copays, deductibles, coinsurance, and charges not covered by insurance. Our fee information is available on request.

  • Cancellations. [Insert cancellation and no-show policy, for example: Please give at least 24 hours' notice to cancel or reschedule. Late cancellations or missed appointments may be subject to a fee of $[amount].]

  • Insurance. It is your responsibility to know your coverage. We may bill your insurer as a courtesy, but you remain responsible for amounts your insurer does not pay.

  • Payments. Online payments are processed by third-party payment providers. We do not store full payment card numbers on our systems.

7.Acceptable Use

You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose

  • Provide false or misleading information, or impersonate another person

  • Attempt to gain unauthorized access to the Website, other accounts, or our systems

  • Interfere with or disrupt the Services, including by introducing viruses or malicious code

  • Use automated tools to scrape, copy, or harvest content or data from the Website

  • Harass, threaten, or abuse our staff or other users

  • Reverse engineer or attempt to extract the source code of any part of the Services

8. Intellectual Property

The Website and its content, including text, logos, graphics, images, and design, are owned by yourMD PLLC or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written permission.

9. Information You Submit

You are responsible for the accuracy of information you submit. By submitting non-PHI content to us, such as feedback or comments, you grant us a non-exclusive, royalty-free license to use it to operate and improve our Services. We handle PHI as described in our Notice of Privacy Practices, and the license in this section does not apply to PHI.

10. Third-Party Links and Services

The Website may link to or integrate with third-party websites and services, such as payment processors, scheduling platforms, or telehealth providers. We do not control and are not responsible for third-party content or practices. Your use of those services is governed by their own terms and policies.

11. Disclaimers

The Website and its non-clinical content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Website will be uninterrupted, secure, or error-free, or that its content is complete, accurate, or current.

Nothing in these Terms is a guarantee of any medical outcome.

12. Limitation of Liability

To the fullest extent permitted by law, yourMD PLLC and its members, providers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of, or inability to use, the Website or online Services.

This section applies to the Website and online Services only. It does not limit or waive any rights or remedies you may have regarding the professional medical care you receive, including claims for professional negligence, and it does not limit liability that cannot be limited under Nevada or federal law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless yourMD PLLC and its members, providers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third party's rights.

14. Termination

We may suspend or end your access to the Website or online Services at any time, with or without notice, if we believe you have violated these Terms or for security, legal, or operational reasons. Ending your online access does not by itself end any provider-patient relationship, which is governed by applicable professional and legal standards, including requirements for appropriate notice and continuity of care.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts, except where applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised version on the Website and update the "Last Updated" date above. Your continued use of the Services after the changes take effect means you accept the revised Terms.

17. General Provisions

These Terms, together with our Privacy Policy and any consents or agreements you sign with us, are the entire agreement between you and yourMD PLLC regarding the Website. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of our practice.
